A WROUGHTON motorist who was found guilty of careless driving has had the conviction thrown out after the only witness passed away.
Streby Margai, 29, launched an appeal after magistrates found the matter proved in his absence.
And prosecutors told Swindon Crown Court they could not contest the matter following the death of their only witness.
Judge Douglas Field ordered that the appeal be allowed even though Margai, of Devizes Road, Wroughton, had not attended the hearing. He had been accused of driving carelessly on March 17 last year.
