A KEBAB shop worker who is accused of taking part in the gang rape of a 41-year-old mum in the staff toilets told police: "She was the one who forced me."

Abdul Shinwari said the woman came in to the shop after midnight and took shine to him when he allowed her to use the facilities, as she said she was desperate to go.

But after she got into the kitchen on the way to the smallest room, the married 25-year-old said she started kissing him, which he tried to stop until he became aroused.

Shinwari, who is on trial at Swindon Crown Court having denied rape, said he then joined her in the toilets where they had sex with her making all the running.

Speaking through a Pashto interpreter the defendant said he came to the UK in 2006 aged 16 after his father, who was an MP in Afghanistan, was killed in the fighting

The devout Muslim said he attained UK citizenship about four years ago, having sat the Life in The UK test, and had never claimed unemployment benefit.

He said in the early hours of Sunday, April 27 last year, he was towards the end of a shift at Sammy's in Clive Parade, where he had worked for about three years.

The woman had clearly been drinking, he told the jury, and came in asking for beer which he told her they did not sell.

"She asked if she could go to the toilet. I told her that the toilet was only for us: staff. She said she was desperate," he said.

"I opened the counter and she came in. When she came to the kitchen I showed her where the toilet was.

"When she entered the kitchen she came towards me. She started kissing me. I asked her to stop it, don't do it. She didn't say anything but she didn't leave me alone.

"She kept kissing me. There was no use of force or anything, she took me to the toilet while kissing me. She was kissing me and I had to walk backwards to the toilet."

Shinwari told the court the couple had sex after he became aroused and gave up his protestations.

Alex Daymond, defending, asked him if he had sex with her without her consent to which he replied: "It was her doing all this to me."

The jury was told after he was arrested he told police, 'she was the one who forced me. I kept telling her she should stop as she was old and had been drinking'.

Earlier the woman had said how she had a few drags of cannabis on to of eight pints of cider and a small glass of champagne at a party.

After going to the takeaway she said one of the men pulled her into the toilets and forced himself on her before his friend, who has never been traced, also raped her.

Shinwari, of County Road, denies two counts of rape.
