THE owner of a car struck during a police car chase through Toothill today (MAY 12) claims his insurance company is refusing to pay out, due to an 'incredible loophole' in his policy.

A silver Peugeot 206 was stopped in Conisborough, after it hit the kerb and collided with a parked red Suzuki SX4 belonging to resident Ian Pearce shortly after midday.

Ian, who has been with Swinton Insurance for many years, said the business is refusing to pay the £200 repair bill because the driver of the other vehicle was uninsured.

He says the company sold him an additional policy to reclaim uninsured losses but in the small print it states the other driver must have insurance.

“It’s an incredible loophole,” the baffled 52-year-old said.

“Why have I for all these years been paying to protect myself against uninsured losses when this happens and they refuse to pay because the driver didn’t have insurance. Am I missing something?

“This additional policy they have been happily selling me for all these years to reclaim "uninsured losses" is actually worthless unless the other party is insured. If they were insured I would not need a legal protection policy for uninsured loss.

“Why the hell sell an extra policy for uninsured losses if you can only claim if the other party has insurance.”

“I will have to pay £200 now, I have no choice but that is the end for me and Swinton.”

“I’m not angry at the police, I understand the police have to do their job and I’m all for that but I don’t understand why I have been paying so much money to cover myself when in reality nothing will be done.”

Swinton Insurance have been contacted for comment.

Wiltshire Police confirmed a man was arrested in a garden in the area after a short chase by officers.

A 21-year-old man is in custody on suspicion of taking a vehicle without consent, dangerous driving and failing to stop for police.

Fellow resident Ray Taylor said the Peugeot had its door taken off by two unmarked police cars who took swift action to arrest the driver.

"I looked out of my window and could see two plain police cars next to the car which was pretty badly damaged with a door off.

"There were police dogs around and a lot of activity with four or five marked police cars."
