A MAN has been fined for breaching a restraining order after allowing his homeless ex-partner to stay at his house.

Stephen Rushton, 35, of Raleigh Avenue, was brought in front of magistrates on Tuesday and told to pay £150 in fines.

The court heard that between May 27 and May 31 Rushton had allowed a woman with whom he has four children and who took out a restraining order against him in July 2012, to stay at his home after she had found herself homeless.

Emma Handslip, defending, said: “He is very concerned about her welfare so he asked her to stay at his house. It was of his own admission that she had stayed there and it was the first breach of the order since it was first issued.”

She described the circumstances of the case as “somewhat strange and unfortunate”.

A Domino's Pizza employee who assaulted a pensioner recovering from a stroke has been banned from seeing her for 28 days.

An application was made on behalf of the woman in her 70s by Wiltshire Police at Swindon Magistrates Court on Monday.

And it was granted by chair of the bench Nigel Spinney, stopping Stephen Horn, 45, of Galsworthy Close, from having contact with the woman so she can seek support.

The court heard from an officer that Horn slapped the woman on her cheek on the afternoon of Saturday, July 10.

“She doesn’t want to make a complaint because she doesn’t want him going back to prison or losing his job at Domino’s,” the officer told the magistrates.

“There have been previous unreported incidents. He had been winding himself up to get into an argument and pester her for money.”

Horn, who was not in court and has a previous conviction for death by dangerous driving, is also banned from going within 200 metres of the woman’s house.

When police stopped a woman driving a Toyota MR2 in South View Avenue they found she was almost three times over the drink-drive limit.

Tracey Jackson, of Munro Close, pleaded guilty to the offence on June 15 when she came before magistrates sitting in Swindon.

The bench disqualified the 44-year-old from driving for 23 months after hearing that she had been found with 100 micrograms of alcohol in 100ml of breath. The legal limit is 35mg. She was also fined £200 and ordered to pay court costs of £85 and a £30 victim surcharge.

An apprentice carpenter has pleaded guilty to causing criminal damage after punching a door in a fit of anger.

On Tuesday, Swindon magistrates heard how Liam Oliver, 22, of Gainsborough Avenue, Royal Wootton Bassett, got into an argument with mum Suzanne over a tax rebate before lashing out and punching the living room door.

The incident took place on May 26 and Linda Holmes, defending, described it as “a difficult family situation”.

Oliver, who has no previous convictions, was charged with criminal damage and ordered to pay £285. He offered to fix the door himself.
