A FATHER breached his bail conditions after bumping into someone he was banned from seeing at a charity fundraising event.

The incident landed Andrew Smith back in court on Tuesday where he admitted the breach of the conditions, which were imposed ten days earlier following a charge of common assault.

The 43-year-old of Beverley in Toothill had been with his family for the Monday Bank Holiday event. But the man was also there and it led to offensive comments from both parties being exchanged.

Prosecutor Vyvyan Thatcher told the court the encounter happened at around 3.15pm in Toothill.

“There were lots of people there, including the [the man],” he said.

After spotting each other, insults between Smith and the man were hurled before the police were called.

The court also heard that Smith had been drinking at the time.

His defence Andrew Watts-Jones said: “Mr Smith takes medication and combined with his high state of emotion it could have had an impact.

“It’s a very sad situation and Mr Smith has learning difficulties from a brain injury he sustained when he was 21.

“[The man] was picking away at Mr Smith by lobbing insults.

“Knowing Mr Smith, [the man] was hoping there would be some sort of reaction. Unfortunately Mr Smith has been stupid enough to react, that is why there was an incident.

“Mr Smith has been a silly chap and he realises he has been silly and has learnt the lesson the hard way.

“You keep your nose in the air and walk in the other direction.”

Chairman of the bench Natalie Cuss told Smith: “This can’t go on.

“You have bail conditions that you are not to contact [the man] and a few other named parties.

“No contact means no contact. You’ve had a warning.”

Smith was released on the same bail conditions which bans him having contact with three people and he must not enter The Village Tavern.

He will appear in court for the charge on common assault on September 21.
