ARNEL Cabrera will finally get his wish to live and work in Swindon after a dramatic Home Office U-turn.

Now he hopes to get his four-year-old son Zac here so that they can rebuild their lives following the tragic blunder at Great Western Hospital that cost him his wife Mayra.

Arnel, 38, had previously only been granted a six-month stay in the UK after his short-term visa was fast-tracked through the system.

However, the Home Office yesterday confirmed Arnel had been granted leave to remain in the country indefinitely.

Mr Cabrera said: “I am so glad that my application was finally granted and I would like to thank everyone who has supported me.

“I look forward to the day when Zac and I can continue our lives here in England as we planned before Mayra’s death.”

Mayra died just an hour after giving birth to Zac at the Great Western Hospital in May 2004 after an epidural was administered wrongly into her arm rather than in her spine.

A jury returned a verdict of unlawful killing at her inquest in February.

Mayra’s death altered Mr Cabrera’s immigration status and his right to live in the UK, and he has been campaigning against this decision with support and funding from Unison.

He returned to the UK a fortnight ago to meet with ministers to plead his case for permanent residency.

A home office spokesperson said: “The minister reviewed this case on compassionate grounds and decided to grant him indefinite leave to remain.”

Immigration minister Liam Byrne MP made the decision officially yesterday, but the first Arnel knew about it was when his new passport arrived with a letter at his solicitors in the post.

Alex Rook from Irwin Mitchell solicitors, who dealt with the immigration side of the case, said: “He was absolutely delighted.

“I think he was a bit shell shocked – he’s been through an awful amount.”

He added he was quite certain Arnel would now make his life here in the UK.

Arnel’s status is not that of a UK citizen, but he can come in and out of the country freely and work freely without applying for a work permit.

“It’s the end of the line in terms of his immigration position – he’s here permanently,” explained Mr Rook.

Now Arnel must make a fresh application for his son Zac, who is currently living in the Philippines, to join him.

South Swindon MP Anne Snelgrove, who has campaigned on Arnel’s behalf, said she had sensed through meetings with Home Office ministers that a positive decision might be forthcoming.

“It was against natural justice in Britain in not allowing him to stay,” she said.

“So I hope Mr Cabrera will now be able to resume his life and be reunited with Zac as soon as possible.

“This case is an exception and we had to persuade the minister that it would not open the gates for people with less pressing reasons to stay in this country.”

She added many people had helped to push Arnel’s case including Councillor Rod Bluh, the Bishop of Swindon Lee Rayfield, the Great Western Hospital and lawyer Lord Joel Joffe, all of whom had written to the Home Office.

Would Anne Snelgrove and the Home Office care to reveal, under a Freedom of Information Act request, just how much this process has cost the taxpayer please?

I have no doubt that Mr Cabrera is delighted but basically the UK government has just allowed a man with zero right to live in the UK to come and live here.

Congratulations to mr Cabrera, and I for one am delighted that it is still possible for this government to see sense.

Farcical Big Mac? That would be the previous 'top story' on the site, keeping ILLEGAL immigrants in our prisons whilst our judicial system takes forever to process their cases. From my limited knowledge on Mr Cabrera's case, he and his wife relocated to the UK as she was working at OUR HOSPITAL, in OUR TOWN. For me, that gives him and his son every right to be here, especially when you consider that his wife was unlawfully killed in the hospital she worked.

Here's hoping that Mr Cabrera and his son will be happy and healthy here in Swindon.

I have no doubt that the cost to give this man permenent residency
In this Country will be met by
Unison,and GWH Trust fund.
Shall we call It an out of Court settlement. All he needs now Is,
fast track housing,and benefits to
cover the cost of heating etc..

Anne Snelgrove has yet again shown that she is only interested in number one. She probably believes that this will endear herself to voters, but I suspect that many will see this 'u' turn as appalling. For my part I have sympathy for this man, but for Anne to say this is 'against natural justice' just indicates how this Government views it's own laws. The man has no legal rights or standing in the UK. Had he been seeking as a Brit to stay in his home country illegally would they have relented, of course not.

We have yet again been shown that our resolve to uphold the law of the land and agreed international protocol and rules, and stick to our Asylum and immigration policy is a joke.

And one question to Anne Snelgrove 'would you like to explain to the 9000 people who according to David Cameron are on Swindon's housing waiting list, why this man will inevitably jump the queue. I am sure they would like to know?'

I repeat I have nothing personal against this man. Are we not told the law is the law and should be applied without fear or favour, or political interference.

FunkyPablo, you don't seem to realise: when Mr Cabrera's wife died he himself became an illegal immigrant.

His fault? No, but that doesn't change the reality.

We hear much of people talking about upholding the law on these pages but, like so much, when it comes down to it we simply pick and choose.

I have absolutely nothing whatsoever against Mr Cabrera and I have immense sympathy for him and his family regarding his wife's untimely demise.

However, NONE of that has any relevance to why a Philippino man and his child should be allowed to come and live in the UK.

The two things are separated by both law and common sense.

What we need to ask ourselves is just why this man was so determined to not return home to the country of his birth and which he'd lived in for 30+ years.

He regularly claims it was his 'wife's wish' that the family live in the UK (which nobody can disprove and is a highly emotive statement in itself - hence I suspect his laywers involvement).

Surely after all that's happened to him and his family in this country it would be the very the LAST place he'd want to live?

I think it is also valid to point out he sent his son to live the Phillipins thus depriving his son of a father whilst he continues to live in the UK. The child having been born here of right is a British citizen, and I share BM's view with regard to him wishing to be here, why would the issue have been discussed with his wife, without wishing to sound 'glib' did they have a premonition of this tragic event.

i'm glad he is allowed to stay.i think he will be a hardworking member of society.most immigrants are not the mythical scroungers that many seem to believe they are.mr cabrera was never a scrounger here.forget the sniping against mp's.it is about right and wrong.
we have a much bigger problem with british scum, who are on the take from the tax payers of this nation.

If it was his wife' wish that they live here permenatly then why did they not apply for citizenship earlier
Why did he send his son back to the Phillipines whilst the case was being contested.

I have nothing personal against the guy but it seems he's taking advantage of a tragic situation

I have no idea what Arnels skills are or how they will benefit this country, so presumably you have some sort of inside knowledge on that matter in order to make that statement. However, as his son is 4 years old, how exactly can you say that he will be an asset to this country?? Isn't that something which remains to be seen?

I have no inside knowledge. Arnel and his wife both moved to this country so that their family could have a better life. Both him and his wife worked hard to get here and once here continued to work at our local hospital. I have every faith that with this kind of determination and attitude Zac is likely to grow up of the same mould.
