Overhaul of licensing laws in the spotlight


GOVERNMENT plans to overhaul the licensing laws for pubs, bars and other premises were discussed by Swindon Council last night.

The Home Office claims the proposals, which are currently out to consultation, will tackle problem establishments and give more powers to local communities.

Swindon’s licensing committee supported the plan to increase fees for premises licences so councils can cover enforcement costs.

They also supported the principal of introducing a levy for late-night licences to pay for the cost of extra policing.

However some members questioned whether it would be practical, stating that it would put extra burden on premises and would be unfair on responsible bars and pubs.

Chairman Vera Tomlinson (Con, Abbey Meads) said: “We would have a lot of licensed premises going bankrupt and we aren’t in the business of trying to close down businesses so we have got to be sensible about it.”

The committee also discussed concerns about the proposal to allow anyone – not just those in the vicinity to the premises – to comment on licence applications.

Lionel Starling, head of licensing, said: “It would mean for example that people in Abbey Meads could comment on something that is happening in the town centre.

“The implication of it is every application that comes in would go to a panel and we would either have to speed the process up massively or it would be hugely expensive.”

Members also raised fears about allowing local authorities to set down their own rules over when licensed premises in their areas could open in the early mornings.

As always Lionel and his team take the objective approach. These new rules would undoubtedly cause considerable 'pain' to an industry already struggling, and would allow for the very 'political' interference the trade always feared when licensing was handed over to the local authority from the Magistrates.

The knives are seemingly out for the parts of society that provide drink and entertainment. Councils who take advantage of the powers as yet another means of bumping up licencing and control will bring about a further raft of closures and the rise of supermarket cheap booze which will fuel the ever increasing vandalism that is already rising at an astonishing rate. Councils are fast losing the will to provide vital services and concentrate on regulatory measures that are eroding centuries of a way of life to many--too many laws have all but destroyed the social nature of our pubs and clubs.

From many posts you clearly enjoy a drink--as many do. Recently you said you now buy from the supermarkets due to the high costs in the pubs. When the new regulations come in to ban cheap drinks many more will follow your example. Combined with the proposed extra charges to be levied on pubs/clubs etc i would suspect even more what i consider are social meeting places will not survive. I rarely drink but do enjoy meeting friends in pubs-if they are smokers i am happy to sit outside with them as smoking does not offend me-the value being in friendship. My thoughts are that legislation is never well thought out to cater for everyone and taxation seems to be targetting social habits and set to continue.

It's only ever about how much money the government (local or national) can screw out of us before the rioting starts, it's only then they 'rethink' their policies. Unfortunately we don't have the revolutionary history of other European countries to keep our leaders in their place in the master-slave relationship.
