A MAN has admitted breaching his restraining order after his former partner gate-crashed a party he was attending to drop off their children.

Dwayne Bryan appeared in the dock from custody at Swindon Magistrates’ Court on Monday wearing a blood-stained shirt having spent the weekend in the cells after he was arrested for breaching his restraining order and being in possession of a bladed article.

The 31-year-old of Pinehurst Road pleaded guilty to both offences, but the court heard that it was the woman he was banned from seeing who had made contact first, before he returned to her address later in the evening.

Crown prosecutor Keith Ballinger told the court that police had attended the woman’s address – who has been protected by the indefinite order since April 26 of this year – after a 999 call from members of the public reporting a disturbance.

“They spoke to the woman and noticed she has some injuries but she didn’t want to provide any details or have any pictures taken of her injuries,” said Mr Ballinger.

“While they were walking back to their vehicle they see someone hiding behind a vehicle 20 metres away and identify him as Mr Bryan. He is found in possession of a pair of red-handled scissors.

“He says she assaulted him over the head with a bottle and at one stage had a knife. Investigations into that are ongoing. He carries the scissors to clean out his grinder. There is no evidence that the scissors have been brandished.”

Defending, Philip Hall told the court: “He went along for a convivial evening at the home of a friend. That is interrupted by the arrival of the woman – it is quite clear from what transpired that she wanted to go out and thought ‘oh look, a free babysitter’.”

Mr Hall said the marks on Bryan's clothing were allegedly his bloodstains which the defendant said was as a result of injuries caused by the complainant.

Sentencing him, chairman of the bench Michael New told Bryan he would be fined £150 for each offence and pay Crown Prosecution Service costs of £85 along with a £30 victim surcharge. Due to him having been in custody since Saturday morning they deemed all of that to be paid as time served and he was released owing nothing to the courts.
