A FORMER soldier accused of secretly filming a sex act on a woman and uploading it to a porn website has been found not guilty of voyeurism.

Marc Jones, of Nepal Road, Tidworth, said the woman, who cannot be named for legal reasons, knew he was filming it because it was "obvious" and because she had consented to it.

The two-day trial at Salisbury Crown Court ended on Wednesday with the jury returning a not guilty verdict.

Giving evidence, the woman said she had not consented and had no recollection of the video being made.

She also said it was at a time in her life when she was depressed and had been drinking heavily to cope with the fact her partner was away. She said she must have been drunk at the time and had only found out about its existence when a friend told her it was online.

However, Mr Jones, 36, said both had been sober during the act and had discussed making a video beforehand with the idea of uploading it to a porn site for both sexual gratification and money.

Defence lawyer Andrew Eddy pointed out that the video, shown to the jury, showed the woman looking into the camera and that there were clearly audible words on the video.

Mr Jones used his phone to make the video, which he said he had held in his hand about 30cm from her.

In summing up to the jury, Judge Douglas Field said: "The nature of this case, some would say, is sordid.

"We have heard a lot of explicit evidence.

"The background is, we have heard, a couple who have betrayed a friend while he was away."

The court heard Mr Jones, who was in the Royal Horse Artillery, served in Iraq, Afghanistan, Kosovo and Bosnia.
