A PAEDOPHILE caught with a stash of more than 200 death porn pictures is unable to complete unpaid work – because he has a bad back.

Dana Feeney, 46, of Castilian Mews, was sentenced in May to a 12 month jail term suspended for two years – with Judge Robert Pawson also ordering the Shaw man to complete 250 hours’ unpaid work.

Feeney had pleaded guilty to possession of 205 extreme pornographic images portraying an act that threatened a person’s life and 18 prohibited images of children. He also admitted making 110 indecent images of children, including 21 in the most serious category.

An application was brought before Swindon Crown Court yesterday to reconsider the sentencing. Mark Ashley, appearing for the Crown, said concerns had been raised at the time by the probation service that a back injury would make him unsuitable for unpaid work. Despite that, he was told to complete 250 hours’ unpaid work as part of his sentence.

Judge Peter Crabtree OBE said the case would be transferred to Bournemouth Crown Court to be heard by Judge Pawson, who originally sentenced Feeney.

“I do not know what was said in court when you were sentenced, but plainly the judge was persuaded to impose a substantial amount of unpaid work,” Judge Crabtree told Feeney.

The case was adjourned to a date to be fixed by the courts.
