A man has been jailed for four years after raping a woman after a night out.
Nicolae Byfield, 34, was sentenced at Swindon Crown Court on Thursday, December 12 having been convicted of two counts of rape on Tuesday, November 19.
Byfield was sentenced to four years in prison on each count, to be served concurrently.
The court heard how Mr Byfield had met up with the victim on a night out.
Byfield offered to give the victim a lift home, but she declined, so she stayed at Mr Byfield's address instead.
Judge Jason Taylor KC said that while there were legitimate grounds on why Byfield could have thought the victim was attracted to him, he nevertheless took advantage of her and had sex with the victim without her consent.
The victim was also under the influence of alcohol when Byfield took advantage of her but was not considered to be incapacitated.
Jude Jason Taylor KC added there were recordings from the incident where the victim can be heard saying no to Mr Byfield's advances.
Alexandra Bull, prosecuting, said that the victim's health had been affected as a result of the offence and that "she wouldn't go back to who she was before".
Ms Bull added that the incident had placed an extra strain on the victim's relationship with her family and friends and also be prescribed antidepressants after having difficulties with sleeping.
In mitigation, Harbinder Singh Lally, defending, said that letters submitted by female members of Byfield's family and friends showed "a different side" of him, and that he was utterly respectful throughout his interaction with the victim up until the relevant period of offending.
Mr Byfield appeared in court via video link from HMP Bullingdon in Oxfordshire.
He has 10 previous convictions since 2006, none of which were considered relevant to his sentencing.
