A jury has been sent home for the night after failing to reach a verdict on whether a kebab shop worker took part in the gang rape of a mum.

Abdul Shinwari, 25, is said to have forced himself on the 41-year-old woman at Sammy's takeaway in Clive Parade last April after she turned up at the door asking for beer.

Shinwari, of County Road, who came to this country from Afghanistan after his MP father was shot dead, told Swindon Crown Court it was she who forced herself on him.

He has pleaded not guilty to two counts of rape and the jury of seven women and five men will continue to deliberate tomorrow.

Before they retired to consider their verdicts James Tucker, prosecuting, told them to ignore the stereotypes that sometimes come with the word rape.

"It doesn't matter that she had been drinking, it doesn't matter she had been smoking cannabis, it doesn't matter that she was on prescription medication," he said.

He said she had gone there that night not looking for sex and the defendant and a friend had both raped her.

But Alex Daymond, defending, told the jury they must be sure that what she was saying was the truth to convict his client.

"This wouldn't be the first time someone has got a bit drunk and had a casual sexual relationship with someone and then regretted it: that is what we say is the case here," he said.

During the trial the woman said she had been drinking on top of anti-depressants and strong painkillers at a party in the Moonrakers pub.

She said she had three pints of cider during the day, starting at 11.30am, then another five in the pub as well as a small glass of champagne.

After the party she said she also had three or four drags on a cannabis joint.

Because of depression and pain she said she was on four kinds of medication and in the past had heard voices in her head telling her to sexual things.

But the woman, who said she had not had sex with her partner of 20 years for 10 months, insisted she was not overly drunk or hearing voices that night.

She told how having been separated from her friends she went to Sammy's asking if they sold beer but was immediately ushered through to the shop to the staff toilets.

There she said she was raped by two members of staff, the other man has never been traced, before being turfed out the back door with a can of pop.

Shinwari told the court that she asked to use the toilet, saying she was desperate to go, and when he let her through she came on to him.

As she kept kissing and groping him he said he became aroused and, with her making all the running, they had sex.

The devout Muslim said he had come to the UK in 2006 as a 16-year-old after his father's death, attaining citizenship about four years ago.
